Bombay High Court Upholds Order in MPID Proceedings Involving BMW India Financial Services

The Petitioner, claiming to be the purchaser of a Rolls Royce Ghost, challenged an order of the Additional Sessions Judge, Pune, passed on his application under Section 91 CrPC in Special MPID Case No. 9 of 2018. He sought to compel BMW India Financial Services to disclose details of the loan foreclosure for the vehicle along with the production of the account statements wherein the amount pertaining to foreclosure was received, alleging that a No Objection Certificate dated May 19, 2017, had been issued in his favour and that he had made payment of INR 90 lakhs towards the same.

On behalf of BMW India Financial Services, it was pointed out from the record that:
– the NOC dated May 19, 2017, was in fact issued in favour of a different entity, not the Petitioner; and
– the INR 90 lakh payment relied upon related to two other vehicles, as shown by contemporaneous correspondence.

Accepting these submissions, Hon’ble Justice Madhav J. Jamdar held that no interference with the impugned order was warranted and disposed of the Writ Petition by order dated September 29, 2026.
